Conditions of Use

Welcome to genesisfundraising.com and myonlinedonation.com. Genesis Fundraising, Inc. provides website features to you subject to the following conditions. If you visit genesisfundraising.com or shop at myonlinedonation.com, you accept these conditions. Any attempt to amend these conditions when ordering product(s) will be null and void, unless otherwise agreed to in writing and signed by both parties beforehand. These terms and conditions, and all other website content, are subject to change at any time, without prior written notice, at Genesis Fundraising's sole discretion.

1. Definitions

   "We", "us" and/or "our" means Genesis Fundraising, Inc. "You" or your" means the individual or entity named on the order invoice or Fundraising Agreement.

2. Payment

   Payment is due at time of order, processed through our designated financial services provider. Advertised prices are in U.S. dollars and include shipping, handling and any taxes due within the state of Florida. We reserve the right to cancel an order if full payment is not made at time of order. Genesis Fundraising is not responsible for pricing or typographical errors in any offering by Genesis Fundraising and we reserve the right to cancel any order resulting from such errors.

3. Taxes

   Unless you provide Genesis Fundraising with a valid tax exempt certificate applicable to your purchase and ship-to location, you are responsible for sales and other taxes associated with the order, except for those orders shipped to the state of Florida.

4. Refunds

   Due to the nature of our business, Genesis Fundraising does not offer refunds once an order is placed. After an item has been received, an order may be returned for another item of equal or greater value only. Any restocking or other service fees applicable for a returned item, as described on the packing slip with your order, will be charged to your credit card.

5. Returns

   You must notify Genesis Fundraising of any damaged or missing items from your order within fourteen (14) days after you receive the order at returns@myonlinedonation.com. Policies and procedures for returned items are described on the packing slip with your order.

6. Products

   Genesis Fundraising attempts to be as accurate as possible in describing products and providing information. However, we do not warrant that product descriptions or any other content of both websites are error-free, accurate, reliable or current. Genesis Fundraising constantly revises its product and services offerings. Genesis Fundraising may revise and/or discontinue products at any time without prior notice to customers.

7. Manufacturers' Product Warranties

   Enclosed with your order, the packing slip will describe the specific manufacturer's product warranty for the item purchased.

8. Limitations of Liability

   THIS SITE AND ALL INFORMATION, CONTENT, PRODUCTS SERVICES AND MATERIALS ARE PROVIDED BY GENESIS FUNDRAISING ON AN "AS IS" AND "AS AVAILABLE" BASIS. GENESIS FUNDRAISING MAKES NO WARRANTIES OR RESPRESENTATIONS ON ANY KIND, IMPLIED OR EXPRESSED, AS TO THE OPERATION OF THIS SITE, UNLESS SPECIFIED OTHERWISE IN WRITING. BY VISITING THIS SITE, YOU EXPRESSLY AGREE THAT YOUR USE OF THIS SITE IS AT YOUR SOLE RISK. 9. Binding Arbitration

   You and Genesis Fundraising agree that any claim, controversy or dispute against Genesis Fundraising SHALL BE RESOLVED EXCLUSIVELY AND FINALLY BY BINDING ARBITRATION ADMINISTERED BY THE NATIONAL ARBITRATION FORUM under its Code of Procedure then in effect. Any award of the arbitrators shall be final and binding on each party and may be entered as a judgment in any court of competent jurisdiction. YOU UNDERSTAND THAT, IN THE ABSENCE OF THIS PROVISION, YOU WOULD HAVE THE RIGHT TO LITIGATE DISPUTES THROUGH A COURT, INCLUDING THE RIGHT TO LITIGATE ON A CLASS-WIDE OR CLASS-ACTION BASIS, AND THAT YOU HAVE EXPRESSLY AND KNOWINGLY WAIVED THOSE RIGHTS AND AGREED TO RESOLVE ANY DISPUTES THROUGH BINDING ARBITRATION IN ACCORDANCE WITH THIS SECTION.

10. Governing Law

    By visiting genesisfundraising.com and myonlinedonation.com, you agree that the laws of the state of Florida, without regard to conflicts of laws principles, will govern these Conditions of Use and any dispute of any sort that may arise between you and Genesis Fundraising.

You are granted a limited, revocable, and nonexclusive right to establish a hyperlink to the homepage of this site so long as the link does not portray Genesis Fundraising or its product offerings and services in a false, misleading, derogatory or otherwise offensive way.

15. Your Account

    When you use this site, you are responsible for maintaining the confidentiality of your account name and password and for restricting access to your computer, and you agree to accept sole responsibility for all sales and communication activity that occurs under your account and password. Genesis Fundraising does not sell products to minor-age children, but it does sell children's items to adults, who can purchase these items with an approved credit card. If you are under the age of eighteen (18), you may use this website only with the involvement of a parent or guardian. Genesis Fundraising reserves the right to refuse service, terminate accounts, cancel orders, or remove or edit content at its own discretion.

16. Risk of Loss

    All products purchased from Genesis Fundraising through myonlinedonation.com are made pursuant to a shipping contract with an assigned Genesis Fundraising carrier. Risk of loss and title for all items pass to you upon our delivery to the carrier.

17. Fundraising Agreement

    All nonprofit organizations visiting genesisfundraising.com may apply for registration on myonlinedonation.com by downloading and submitting the standard Fundraising Agreement contained on genesisfundraising.com. All necessary documents and signatures are required before your organization is placed as an approved nonprofit entity on myonlinedonation.com.

18. Miscellaneous Provisions

    A. You may not register or use any internet domain name that contains the names Genesis Fundraising or myonlinedonation.com in whole or in part or any other name that is confusingly similar thereto.
    B. The section headings used herein are for reference only and do not form a part of the terms and conditions directly or indirectly.
    C. If any term of this agreement is found by a court of competent jurisdiction to be unenforceable, the enforceability of the remaining provisions shall not be affected or impaired.
